The Consumer Financial Protection Bureau opens its doors
By: David AbramsJuly 28, 2011
The Consumer Financial Protection Bureau (CFPB) opened its doors this month.
This is both a historic event and a great opportunity for the American people to create a stronger and fairer economic future. This new Bureau will function to oversee the consumer financial markets of our nation.
The importance of integrity and fairness in our consumer financial markets cannot be understated. I have personally witnessed many families in our community who have had their hard work and dreams stolen from them by unfair and deceptive lending practices.
Inadequately regulated residential mortgage companies, credit card companies, and consumer finance companies have created a cancer in the American economy. Ethical lenders were placed at a competitive disadvantage as the entire consumer finance industry engaged in a race to the bottom in search of record profits based upon toxic loan products. This economic cancer continues to create mistrust in the financial services industry for investors, lenders, and borrowers.
It has given rise to the foreclosure epidemic that has eroded the investment we have made in our homes and contributed to continued job loss in our communities.
The formation of the CFPB is an important step in beginning what promises to be a long and difficult recovery. The CFPB will supervise the consumer credit marketplace to ensure compliance with our Federal consumer protection laws. It will function as a resource for policy makers by gathering and analyzing data on the consumer credit markets.
Perhaps most importantly, the new CFPB will work to educate consumers so that we have the knowledge to protect ourselves from predatory lenders. This multi-pronged approach will help ensure that we have a consumer credit marketplace with integrity, where consumers are properly informed so that they can make a meaningful comparison among loan products, and the industry itself does not engage in another competition to the bottom driven by unethical lenders.
Unfortunately, there are many politicians in Washington, D.C. who are working hard to see that this new agency either never functions or lacks the ability to perform its mission.
There exists a very real possibility that this vital and necessary agency will become so politically hamstrung or unfunded that it will be impotent in performing its mission.
We live in an era where the financial services industry wields incredible political power through its ability to generate massive amounts of financial support for candidates for political office. This industry, with its massive executive bonuses and consolidation of the national wealth, has fought the CFPB since its inception.
The strength of opposition coming from the financial services industry is clearly evident in their recent success in blocking the appointment of Elizabeth Warren as director. Republican lawmakers had pledged to block her appointment as director even though she first envisioned such an agency, has done an excellent job putting it together, and it is reported that the Progressive Change Committee collected 350,000 petition signatures in support of her appointment as director.
Economic recovery for the middle class depends in part upon a reformation of our consumer credit markets. Families borrowing to purchase a home, financing a car, or taking out a credit card must be given clear and accurate information regarding those transactions. We have all seen ample evidence of how toxic credit products hurt everyone, not just the borrower. Therefore, we must keep the pressure on our politicians not to pursue their own self interest and give into the banks and finance companies. We must ensure the CFPB is not just a figurehead, but a strong, effective watchdog of the consumer credit market.
